Alexandra Elbakyan and Sci-Hub

Abstract

In 2011, a frustrated graduate student in Kazakhstan built a website to solve a problem she faced daily: the research papers she needed cost $30 or more apiece, locked behind publisher paywalls she could not afford. Sci-Hub automated the workaround, feed it a paper’s identifier and it would fetch the full text, using donated university credentials and a growing private cache, and hand it over for free. Within a decade Alexandra Elbakyan’s creation held a near-complete copy of the world’s paywalled scientific literature (on the order of 88 million papers) and served millions of downloads a day to researchers, doctors, and students on every continent. To the academic publishing industry she is a copyright criminal who has been hit with multi-million-dollar judgments and is reportedly the subject of an FBI inquiry. To a large share of the world’s working scientists she is the person who finally made the research they themselves wrote, reviewed, and funded actually readable. Like Aaron Swartz before her, she turned the economics of scholarly publishing into a question about who science is for.

The Paywall Problem

Modern scientific publishing has a structure that strikes many of its own participants as indefensible. Researchers (typically funded by public grants) write papers and give them to journals for free. Other researchers peer-review them for free. The publisher then sells access back to the universities and the public, often at $30–$50 per article or through institutional subscriptions costing millions a year, while the largest publishers post profit margins rivaling the most lucrative industries on earth. A scientist at a wealthy Western university barely notices, because the library pays. A scientist in Kazakhstan, India, Iran, or Brazil hits a wall on nearly every paper.

Alexandra Elbakyan was born on November 6, 1988, in Almaty, Kazakhstan. She started programming at twelve, earned a computer-science degree specializing in information security, and went into neuroscience research, work that required reading enormous quantities of literature she could not legally afford. She experienced the paywall not as an abstraction but as a daily obstacle to doing science at all.

Building Sci-Hub

Elbakyan launched Sci-Hub in 2011. The mechanism was elegant. When a user requested a paper, Sci-Hub first checked its own repository; if the paper was not yet stored, it retrieved the article in real time using access credentials donated by people at subscribing institutions, delivered the PDF to the user, and saved a copy so the next request could be served directly. Over time the cache grew toward a near-complete mirror of the paywalled corpus. Combined with LibGen and other shadow libraries, Sci-Hub effectively unbundled scholarly publishing from its payment system.

Adoption was explosive and global. Usage data showed Sci-Hub being hit not only from the developing world but heavily from within wealthy universities whose researchers found it faster and less friction-laden than their own libraries’ official access. By the early 2020s the archive held roughly 88 million articles, by many estimates the substantial majority of all paywalled research literature ever published.

Why Scientists Defend a Copyright Pirate

Sci-Hub’s moral claim is unusually strong because of who is harmed and who benefits. The “stolen” goods were, in most cases, produced with public money, donated by their authors, and reviewed by unpaid volunteers; the party losing revenue is a small set of highly profitable commercial publishers who added distribution but not the underlying scholarship. Many researchers argue that paywalling publicly funded knowledge is the real offense and that Sci-Hub merely routes around it. This is why surveys and editorials in journals like Science and Nature found large fractions of scientists openly admitting to using it, a level of elite professional support no ordinary piracy operation enjoys.

The Lawsuits

The publishing industry responded with the courts. In 2015, Elsevier (the largest scientific publisher) sued Sci-Hub and Elbakyan in US federal court for copyright infringement. Elbakyan, in Kazakhstan and beyond US reach, did not mount a full defense; she did write to the court arguing that Elsevier’s business model was itself unjust. In 2017 the court awarded Elsevier $15 million in damages, and the American Chemical Society won a separate judgment and an injunction directing internet intermediaries to help block the site. Courts and regulators in India, France, and elsewhere have since heard their own blocking cases, with varying results, an Indian case brought by Elsevier and others has drawn unusual support from scientists arguing for a research exception.

The judgments are essentially uncollectible and the injunctions only partly effective: Sci-Hub reappears under new domains and remains reachable through mirrors and the Tor network. The legal campaign has constrained but not closed it.

The GRU Cloud

In December 2019, The Washington Post reported that the US Department of Justice was investigating whether Elbakyan had ties to Russian military intelligence (the GRU) and whether Sci-Hub’s credential harvesting had been used to obtain more than scientific papers. Elbakyan flatly denied any intelligence connection, characterizing the inquiry as an attempt to recast a one-woman open-access project as a national-security threat. No charges of that kind have been made public. The episode nonetheless darkened her image in the West and illustrated how a tool built on mass credential-sharing inevitably raises questions about what else those credentials could reach.

Swartz, and the Unfinished Argument

Elbakyan is routinely compared to Aaron Swartz, who in 2010–2011 downloaded millions of articles from JSTOR and was prosecuted so aggressively under the Computer Fraud and Abuse Act that the case is widely linked to his 2013 suicide. The comparison is apt and pointed: Swartz sought to liberate a closed archive and was destroyed by the attempt before he could release anything; Elbakyan actually built and ran the thing Swartz was accused of intending, at vastly larger scale, and (protected by distance and jurisdiction) has kept it running for over a decade. In 2016, Nature named her one of the ten people who most mattered in science that year, a striking acknowledgment from inside the establishment she had defied.

Her impact runs along the encyclopedia’s law, policy, and culture axes rather than its technology axis: Sci-Hub is not a technical breakthrough but a logistical and political one. It made the dysfunction of academic publishing impossible to ignore, accelerated the legitimate open-access movement (mandates, preprint servers, “read-and-publish” deals), and forced the largest publishers to defend a paywall that their own contributors increasingly route around. She is documented here on the principle of impact, not endorsement: Sci-Hub is, as a legal matter, mass copyright infringement built partly on misappropriated credentials, and it is also, for millions of scientists, the tool that made the literature usable. Both are true, and the tension between them is the point.
